§ 1 General Terms

The contest is organized by LabV Intelligent Solutions GmbH, a company formed and existing under the laws of Germany, having its principle place of business in Munich, DE-81539, Frankenthaler Strasse 20. By participating in the prize draw, the participants hereby consent to the terms and conditions of the prize draw. A purchase or transaction is not required to participate or win.

§ 2 Participation Period

LabV Intelligent Solutions GmbH is not responsible for any lost, late, misdirected, stolen, illegible or incomplete entries. If, for any reason, the prize draw is not capable of running as planned, caused by e.g. infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of LabV Intelligent Solutions GmbH which corrupt or affect the administration, security, fairness, integrity or proper conduct of the prize draw, LabV Intelligent Solutions GmbH reserves the right at its sole discretion to cancel, terminate, modify or suspend the contest and/or select winners from all eligible entries received prior to the cancellation. LabV Intelligent Solutions GmbH reserves the right to correct any typo-graphical, printing, computer programming or operating errors at any time.

§ 3 Eligibility for Participation

The prize draw is only open to legally competent individuals (referred to as “participants”). A person participating must, at the time of entry into the contest, be over 18 years of age. A person participating can only enter the prize draw once. LabV employees and their immediate family are not permitted to enter the prize draw.

§ 4 Process
The participation will happen by adding their contact information on https://events.labv.io/gewinnspiel. All of the above described conditions have to be fulfilled in order to enter the prize draw.

The winner will be selected randomly and will be informed in via an email or aLinkedIn Direct Message. All prizes and the respective shipping of them is free of charge for the winners and will be shipped to the winners’ address. No cash disbursement and/or a replacement of the prizes is possible.
§ 5 Liability / Legal Process
LabV Intelligent Solutions GmbH shall be liable for damages in connection with the competition exclusively in cases of intent or gross negligence on the part of LabV or a representative or vicarious agent as well as culpably caused injury to life, limb or health in accordance with the statutory provisions. Apart from that, LabV is liable according to the Product Liability Act, due to the culpable breach of essential contractual obligations or insofar as a defect was fraudulently concealed or a guarantee for the quality of the delivery item was assumed. However, the claim for damages for the culpable breach of essential contractual obligations is limited to the contractually foreseeable damage, unless another of the cases listed in p. 1 or p. For simple negligent breaches of non-essential secondary obligations liability is excluded.

§ 6 Privacy

LabV grants the highest possible data protection standard as part of the prize draw and observes all relevant legal provisions in this regard. In this respect, we refer to our privacy policy, which can be retrieved here. In particular, LabV will not sell any address details to third parties.
LabV collects, stores and uses the personal data of the respective participant for the purpose of the proper conduct of the competition as well as in the context of any consent expressly declared by the participant. The participant agrees with the participation that in case of profit his / her name will be published on the internet.

§ 7 Jurisdiction

For disputes, German law applies exclusively. As far as legally permissible, the seat of LabV in Germany is agreed as place of jurisdiction. Insofar as the participant has no general place of jurisdiction in Germany, or relocates the domicile abroad after the participation, the seat of LabV is also agreed as place of jurisdiction.

§ 8 Severability Clause

Should a provision of these conditions of participation be or become wholly or partially ineffective, the validity of these conditions of participation will not be affected. Instead of the ineffective provision, the legally permissible provision which most closely approximates the meaning and purpose expressed in the invalid provision shall apply. The same applies in the event of the existence of a loophole in these conditions of participation.
